Probate is a general theme that deals with the administration of a person’s estate following their death.  Technically a Grant of Probate is only issued where a person has died leaving a valid Will and a suitable executor to deal with the estate.  In other cases the Courts would have issued a Grant of Letters of Administration but together they are usually described as Probate.
When a person dies, with assets in the United Kingdom, then in most cases in order to get access to the funds you will need to apply to the High Court for a Grant.  If however the estate is relatively small then on many occasions we can deal with the estate under the Administration of Small Estates Act.
Connected with Probate is the situation over Inheritance Tax.  Before you can obtain a Grant of Probate, you have to file Formal Inheritance Tax Accounts with the Inland Revenue but, if your estate is below the tax threshold or one of the excepted estates then you can often file a short form of accounts.

These days, many estates we deal with also have foreign assets.  Some countries are willing to deal with those assets with an English Grant of Probate, resealed in that country, or there may be occasions when we need to apply for a second Grant abroad.
